1. Who we are and what these terms cover

These terms apply to every app published on the App Store by DOKU YAPAY ZEKA YAZILIM TEKNOLOJİ LİMİTED ŞİRKETİ (“Doku Labs”, “we”), Caferağa Mah. Şifa Sk. No: 19, 34710 Kadıköy/İstanbul, Türkiye, and to its related websites (together, the “Apps”). They supplement Apple’s Standard End User License Agreement (the “Apple EULA”). By downloading or using an App you accept these terms; if you do not accept them, do not use the App.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Apps on Apple devices you own or control, for your own non-commercial purposes, in line with the Apple EULA and the App Store rules. The Apps are licensed, not sold. All rights not expressly granted are reserved.

3. Acceptable use

You agree not to:

• copy, modify, decompile, reverse-engineer or disassemble an App, or try to extract its source code, except where the law expressly allows it;
• use cheats, bots, scripts, modified clients or any automated means, or exploit bugs, to gain an advantage or to affect other users;
• click, view or otherwise interact with ads fraudulently or in an automated way, or interfere with ads or attribution;
• interfere with, overload or attempt to gain unauthorised access to an App, its servers or the services it relies on;
• use an App in breach of any law, or to infringe anyone’s rights;
• remove or alter any copyright, trademark or other notice.

We may suspend or end your use of an App, or features of it, if you break these terms.

4. Our content and intellectual property

The Apps and all their content — including code, design, graphics, characters, sounds, text, names and logos — belong to Doku Labs or its licensors and are protected by intellectual property laws. Nothing in these terms transfers any of these rights to you.

5. Virtual items, progress and purchases

Points, scores, rewards, unlocked content and any other in-app items have no monetary value, cannot be exchanged for money, and are licensed to you for use in the App only. Progress may be stored only on your device and can be lost if you delete the App, change device or restore without a backup. Any purchase is processed by Apple; refunds are handled by Apple under its own policies, subject to your statutory rights.

6. Advertising and third-party services

Some Apps are free because they show ads. Ads and any linked products, apps or websites are provided by third parties, who are solely responsible for them. The Apps also rely on third-party services (for example ad networks, analytics and Apple services such as iCloud and Health). Your use of those services is also governed by their own terms, and we are not responsible for their availability or conduct. 7. Health, wellbeing and educational content

Where an App offers habit, fitness, fasting, wellbeing or educational features, it is for general information and personal motivation only. It is not medical, nutritional, psychological or professional advice, diagnosis or treatment, and it is not a medical device. Consult a qualified professional before starting a diet, fast or exercise programme, and stop and seek help if you feel unwell. Figures shown, such as calories, steps or durations, are estimates and may be inaccurate.

8. Children

Some Apps may appeal to children. A child should use an App only with the permission and supervision of a parent or guardian, who is responsible for that use and accepts these terms on the child’s behalf.

9. Changes and availability

We may update, change, suspend or discontinue an App or any feature, content or ad format at any time, with or without notice. We do not guarantee that an App will always be available, uninterrupted, error-free or compatible with every device or operating-system version. Some updates may be required to keep using an App.

10. Disclaimer

To the fullest extent permitted by law, the Apps are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. Nothing in these terms limits rights you have under mandatory consumer-protection law.

11. Limitation of liability

To the fullest extent permitted by law, Doku Labs, its shareholders, managers, employees and contractors are not liable for any indirect, incidental, special or consequential loss, or for loss of data, progress, profit or goodwill, arising from use of or inability to use the Apps. Our total liability for any claim relating to an App is limited to the amount you paid us for that App in the twelve months before the claim, or the equivalent of USD 50 if you paid nothing. These limits do not apply to liability that cannot be limited by law, including liability for intent or gross negligence (Turkish Code of Obligations art. 115) or for death or personal injury.

12. Indemnity

To the extent permitted by law, you agree to compensate Doku Labs for claims, losses and reasonable costs arising from your breach of these terms or misuse of an App.

13. Changes to these terms

We may change these terms. The current version is always on this page with its date. Continuing to use an App after a change means you accept the updated terms.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. Istanbul (Anadolu) Courts and Enforcement Offices have jurisdiction, without prejudice to mandatory rules that let consumers apply to the consumer arbitration committees or consumer courts of their own place of residence, or that give consumers outside Türkiye the protection of the law of their country.

15. General

If any part of these terms is found invalid, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms; we may transfer ours, including to a successor of Doku Labs or of an App. These terms are published in Turkish and English; if they differ, the Turkish version prevails.
